Terms & Conditions and Operational Rules Use of Network and Resources These rules and conditions are designed to protect the First Communications network and system, its employees and its users. They are also provided to make your use of SkyLAN® and the Internet a positive and secure experience for everyone involved. We believe that our customers freedom and privacy are of paramount importance and that these rules serve to secure that freedom and privacy. Becoming an SkyLAN® user constitutes an agreement to abide by these rules. All references to SkyLAN® in Terms and Conditions and Operational Rules include the system and its employees. Network use will be deemed as acknowledgement that the user has read and agrees with these terms and conditions and other started rules and policies. SkyLAN® cannot be used for any illegal activities or other purposes prohibited by law. SkyLAN® services may be used only for lawful purposes. Transmission or solicitation for reception of material which violates US Federal or Ohio State Law, or State Law of the state you reside in, or Local Law of the township you reside is prohibited. This includes material that is threatening, legally obscene, libelous, or violates trade-secret, patent, or copyright protections. You agree to indemnify and hold harmless SkyLAN®, its owners and employees from all claims which are a result of your usage, without limitation. SkyLAN® does not tolerate the use of materials on any web site hosted by SkyLAN® which infringes on a copyright. If you know of any such material, click here. The security of your network, including the passwords, is your responsibility and that all use which emanates from your account will be considered to be undertaken by you unless it can be shown to have been an unauthorized intrusion. You agree to notify SkyLAN® immediately if you believe that your connection, account or your password has been or is being compromised in any manner. The account holder agrees that failure to pay outstanding balances when due will constitute account default and be cause for service termination without notice. Resale and reassignment of SkyLAN® services are strictly prohibited. SkyLAN® makes no warranties or representations of any kind, whether expressed or implied, for the services which are being provided. SkyLAN® explicitly disclaim any warranty of merchantability or fitness for any purpose whatsoever. SkyLAN® will not be responsible for any damage you suffer as a result of using SkyLAN® services regardless of cause, including but not limited to loss of data resulting from delays, improper or incomplete delivery of information, service interruptions caused by SkyLAN's own negligence, SkyLAN's providers and/or possible malicious computer viruses. SkyLAN® has no control whatsoever over the information passing through its system. Use of any information obtained through SkyLAN® is at your own risk. SkyLAN® specifically denies any responsibility for the accuracy or quality of information obtained through its services. The transmission of unsolicited advertising through mass-electronic mail, USENet postings to inappropriate groups, or other direct transmission is prohibited. However, posts made to appropriate USENet groups as well as commercial use of SkyLAN® is encouraged. You agree not to abuse the system and its resources, including any quota on usage which may be imposed and policies on the the use of resources which reach beyond this system. You agree not to attempt to violate the security of this system's authentication and accounting procedures. The customer or user shall obey SkyLAN® acceptable use policies. Although the SkyLAN® system is on a commercial exchange, the customer or user assumes all the risks of transferring prohibited material across restrictive Networks and transgressing their acceptable use policies. Otherwise, the Internet can be used for business purposes in almost all cases. Expressly prohibited activities include: Falsifying email or IP addresses. Advertising or sending promotional materials to others without prior express agreement from such others. Posting advertisements to inappropriate USENet newsgroups is also expressly prohibited. Implicitly prohibited activities include the unlicensed international export of various materials. The customer or user is responsible for learning these policies, but SkyLAN® employees will be happy to assist. Users may not use SkyLAN® FTP service to attempt to transfer any files not specifically permitted, or access hosts which do not permit anonymous transfers (unless the transfer is to or from an account you are authorized to use on the remote host). Any attempt to cause traffic levels to SkyLAN® or other Networks to rise without reason or for malicious purpose is prohibited. SkyLAN® reserves the right to change these terms and conditions at any time, as well as the services offered. Posting of the new terms and conditions or service changes on the system in a conspicuous place on our network shall constitute proper notice. SkyLAN® reserves the right to modify published rules at any time by publishing such modifications over the service and/or sending notices to each customer and user. The customer or user agrees to waive all claims against SkyLAN®, legal or otherwise incurred through the use of the SkyLAN® system or the Internet and its systems. The customer also agrees to indemnify and hold harmless SkyLAN® from any claims and expenses related to the customer's or user's violation of the Operational Rules or the Service Agreement Terms. Violation of any of the terms and conditions of service may result in the cancellation of your contract and the forfeiture of the remainder of your pre-paid fees. Serious violations may result in civil and/or criminal prosecution. SkyLAN® operates under the laws of the State of Ohio, and the United States of America and local laws and restrictions.
